BMA Working Group Nuevo León Chapter: Regularization of Real Estate Pre-Sales in the State of Nuevo León

At Newlex, we believe that the growth of the real estate sector requires a clear and fair legal framework that fosters trust among developers, investors, and buyers.
Our Managing Partner, Axel Estrada, recently participated in a working group organized by the Mexican Bar Association (BMA), Nuevo León Chapter, where the topic of real estate pre-sales and their importance as a financing mechanism within urban development was discussed.
Currently, pre-sales represent a legitimate tool that enables the financial feasibility of projects. However, the lack of specific regulation has created an environment prone to practices that may jeopardize both buyers’ assets and the reputation of the industry itself.
During the session, participants agreed on the need to strengthen the legal framework through three key areas:
Urban: Integrate the pre-sale figure into the authorization process alongside the construction permit, providing greater control and transparency in developments.
Civil: Recognize pre-sales as a form of preliminary contract, setting minimum requirements such as proof of property ownership and verification of its legal status.
Criminal: Explicitly define and penalize cases of fraud or misrepresentation to provide stronger legal protection for buyers.
The shared goal is clear: to protect buyers’ assets without hindering a legitimate economic activity that drives urban growth and creates community value.
From our perspective, effective regulation should not slow down real estate activity but organize it and bring legal certainty, contributing to a more transparent, competitive, and sustainable environment.
