PRIVACY NOTICE
In order to comply with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDPPP” and/or the “Law”) and the Regulation of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Regulation”), we inform you of the privacy policies of NEWLEX ABOGADOS, S.C. (“NEWLEX”) regarding the information that it collects from the user when using its website or establishing business relationships by any other means. Likewise, and in accordance with the Law, this notice explains how such data are collected and how they are used. This notice also explains how the user may limit the use of such data and the procedure for exercising the rights of access, rectification, cancellation and objection (the “ARCO Rights”).
I. Data Protection Officer
Pursuant to Articles 15, 16 and following of the Law and its Regulation, you are informed that Newlex is responsible for collecting, using and protecting the personal data of our clients, in compliance with the principles of legality, quality, consent, information, purpose, loyalty, proportionality and accountability—all of which are established as guiding principles for the handling of personal data under the Law—to foster trust in each of our clients when providing their personal data.
II. Identity and Address of the Data-Processing Officer
The office responsible for processing personal data is located in the area designated by Newlex, and is in charge of the security and responsible management of your personal data, as well as attending to any requests the client may make to exercise the rights described herein, in accordance with the scope and procedures set forth by applicable Mexican law.

III. Primary Purposes of Data Processing
In accordance with Articles 40, 41 and 42 of the Regulation, your personal data will be used for the following purposes, which are necessary to establish a business relationship with Newlex:

To determine payment methods for our products and services;

Management, control, administration and updating of information related to clients and their legal representatives (if the client is a legal entity), necessary to enter into and confirm transactions, contract services with Newlex, and ensure transaction security and confidentiality;

Analysis of creditworthiness, financial solvency and payment capacity of Newlex’s clients;

Analysis of clients’ personal, employment and financial profiles, under applicable law;

Management, control and administration of communications between Newlex and its clients;

Monitoring, control and evaluation of audits to ensure compliance with national and international legislation and treaties to which Mexico is a party;

Ensuring compliance with confidentiality, integrity and transparency obligations, as well as legal provisions on anti–money laundering and counter-terrorism financing and other sector-specific regulations, through administrative and technical procedures;

Management of judicial or extrajudicial collection of fees for services provided by Newlex;

Statistical and historical records of clients and their legal representatives;

Issuance of electronic tax receipts (CFDI) via email;

Establishment of monetary guarantees for lines of credit;

Establishment of mortgage, pledge, letter-of-credit and/or surety guarantees;

Implementation of various legal contracts applicable to business relationships with Newlex;

Evaluation and execution of debt acknowledgment agreements, restructurings and financings;

Management and processing of collections;

Sending and receiving payments;

Credit bureau investigations of payment and credit behavior;

Real-estate registry searches in the Public Registry of Property and Commerce;

Authentication of signatures in various commercial operations with Newlex;

Evaluation of credit and cash-purchase applications;

Requesting bank references;

Notifying you about new products and services;

Processing your purchase orders and product deliveries;

Handling your complaints or suggestions;

Addressing your questions and comments;

Compiling statistics on consumption habits and services; and

Evaluating the services provided.
IV. Secondary Purposes of Data Processing
Additionally, we will use your personal information for the following secondary purposes, which are not necessary for a business relationship but help us maintain closeness with clients and promote our products and services:

To offer special offers and promotions;

To provide advertising support; and

To establish commercial partnerships.
If you do not wish your personal data to be used for any or all of these secondary purposes, please follow the procedure outlined under “Limitation of Use and Disclosure of Your Data.” Your refusal to have your data used for secondary purposes will not be grounds for terminating your relationship with Newlex.

From public agencies (federal, state or municipal), commissions, institutes and regulatory entities for the purposes of compliance with information, transparency and anti–money laundering obligations, or to comply with judicial or administrative requirements;

VII. Sensitive Data
Newlex does NOT collect sensitive personal data from its clients or suppliers.
VIII. Cookies and Web Beacons
Our websites may use cookies, web beacons and other tracking technologies to fulfill the purposes described in this Privacy Notice. Cookies and web beacons are data files stored on your device that exchange session, authentication or preference information between the site and your browser.
IX. Data Transfers
We will only transfer your personal data to third parties, whether national or foreign, who are legally or commercially related to us to fulfill the purposes described in this Notice, and in accordance with the exceptions set forth in Article 37 of the Law and its Regulation. Possible recipients include:

Tax Administration Service (SAT);

Commercial partners/affiliates;

Notary publics; and
-
External attorneys/collections firms.
These transfers will be made for the following purposes:

To comply with fiscal legislation;

To enhance or expand service and commercial objectives;

To formalize notarial instruments arising from commercial relationships; and

To carry out necessary legal and collection activities.
X. Data Security
Your personal data are kept confidential and protected by administrative, technical and physical security measures—such as access-controlled internal databases, periodic password changes and confidentiality agreements with data handlers—to prevent damage, loss, alteration, destruction, unauthorized use, access or disclosure. Confidentiality obligations survive the end of the relationship; however, Newlex is not liable for misuse of data by former employees acting in bad faith.
XI. Limitation or Revocation of Use and Disclosure
If you wish to limit or revoke consent to the processing of your personal data in whole or in part, you may request the “Request to Limit Use or Disclosure,” available at our office or via email. This request follows the same procedure as ARCO rights.
XII. Procedure for Exercising ARCO Rights
Under the Law, you or your legal representative may exercise your rights of Access, Rectification, Cancellation and Opposition directly with Newlex:

Access: Request to know what data we hold about you.

Rectification: Request correction of inaccurate or incomplete data (with supporting documents).

Cancellation: Request deletion of data, which will enter a blocking period prior to removal.

Opposition: Object to processing for justified reasons.
To exercise these rights, submit the ARCO Rights Request Form—identifying the data in question and attaching ID documents—to the Data Protection Office. You will receive an acknowledgment with the date of receipt. We will respond within 20 business days (extendable by 20 days with notice). If your request is granted, we will carry out the action within 15 days of responding (extendable by 15 days with notice).
If you believe your data-protection rights have been violated, you may file a complaint with the National Institute for Transparency, Access to Information and Personal Data Protection (INAI) at www.ifai.org.mx.
XIII. Changes to This Privacy Notice
We reserve the right to modify or update this Privacy Notice at any time due to legal developments, internal policies or service requirements. Updated versions will be available on our website (newlex.mx) and posted in our offices.
